These Terms and Conditions ("Terms") govern your use of the website operated by Kelly Peters Art ("Kelly Peters Art," "we," "us," or "our"), including kellypetersart.com and any related pages, online stores, services, products, artwork, workshops, classes, commissions, and offerings provided through the website (collectively, the "Site" or "Services").
By accessing the Site, purchasing a product or artwork, booking a service, registering for a class or event, or otherwise using our Services, you agree to these Terms.
If you do not agree to these Terms, please do not use the Site or purchase our products or Services.
These Terms should be read together with our Privacy Policy and any Shipping, Returns, Commission, Workshop, or other policies displayed on the Site or provided in connection with a particular purchase or service.
1. ABOUT KELLY PETERS ART
Kelly Peters Art is an independent artist business offering original artwork, fine art prints and reproductions, commissioned artwork, murals, creative services, art classes, workshops, events, licensing opportunities, and related products and services.

2. ELIGIBILITY AND USE OF THE SITE
By using this Site or making a purchase, you represent that you are legally capable of entering into a binding agreement.
You agree not to use the Site or Services for unlawful, fraudulent, abusive, infringing, or unauthorized purposes.
You may not interfere with the operation or security of the Site, attempt unauthorized access to the Site or its systems, introduce malicious software, scrape or systematically collect Site content in violation of these Terms or applicable law, or use automated systems in a manner that places an unreasonable burden on the Site.
3. ORDERS
When you place an order, you represent that the information you provide is accurate and that you are authorized to use the payment method submitted.
Submitting an order does not necessarily guarantee acceptance of that order.
We reserve the right, to the extent permitted by law, to refuse or cancel an order because of product availability, pricing or listing errors, suspected fraud, payment issues, technical errors, or other legitimate business reasons.
If payment has already been collected for an order that we cancel, the applicable amount will be refunded.
4. PRICING AND PAYMENT
Prices are displayed in U.S. dollars unless otherwise stated.
Applicable taxes, shipping, delivery, framing, installation, handling, or other charges may be added where disclosed at checkout, on an invoice, in a proposal, or in a separate written agreement.
We reserve the right to change prices at any time before an order has been accepted.
If a product or service is accidentally listed at an incorrect price because of a typographical, technical, or other error, we reserve the right to correct the error and cancel the affected transaction as permitted by applicable law.
Payment processing may be provided by third-party payment processors. Your use of those payment services may also be subject to their terms and privacy policies.
5. ORIGINAL ARTWORK
Original artwork is individually created by Kelly Peters.
Variations, irregularities, visible texture, brushwork, layering, raw edges, drips, marks, surface variation, exposed materials, and other characteristics may be intentional aspects of an original artwork and are not necessarily defects.
Every reasonable effort is made to photograph and represent artwork accurately. However, screens, lighting conditions, photography, browsers, and devices can cause colors and details to appear differently.
Minor differences between the appearance of artwork online and its appearance in person do not necessarily constitute a defect or misrepresentation.
Dimensions listed for handmade artwork may have minor variations.
6. OWNERSHIP OF ORIGINAL ARTWORK VS. COPYRIGHT
Purchasing an original artwork transfers ownership of the physical artwork only.
It does not transfer the copyright or other intellectual property rights in the artwork.
Unless Kelly Peters expressly transfers specific rights through a separate written agreement signed by Kelly Peters, all copyrights and reproduction rights remain with Kelly Peters.
The purchaser of an original artwork therefore does not acquire the right to reproduce, manufacture, commercially exploit, license, publish, distribute, or create commercial products from the artwork merely because the purchaser owns the physical artwork.
7. PRINTS AND REPRODUCTIONS
Prints and reproductions offered by Kelly Peters Art are authorized reproductions of artwork by Kelly Peters.
Purchase of a print or reproduction transfers ownership of the physical item purchased only.
It does not transfer copyright, reproduction rights, licensing rights, digital rights, merchandising rights, or other intellectual property rights in the underlying artwork.
A purchaser may not reproduce a purchased print or artwork in another format or medium for commercial purposes without prior written authorization.
This includes creating additional prints, posters, canvases, merchandise, apparel, home goods, digital products, commercial graphics, or other reproductions.
8. LIMITED EDITIONS
When a product is expressly identified as a limited edition, the applicable product description will identify the edition or other relevant characteristics.
Limited-edition status applies to the particular edition described in the listing.
Unless Kelly Peters expressly agrees otherwise in writing, sale of a limited-edition print does not transfer or relinquish Kelly Peters's underlying copyright in the artwork.
Kelly Peters may continue to display, publish, license, archive, promote, and otherwise use images of the underlying artwork as permitted by law.
Any restrictions Kelly Peters voluntarily places on future editions, sizes, substrates, or formats will be determined by the specific description or certificate associated with that edition and should not be assumed unless expressly stated.
9. INTELLECTUAL PROPERTY
The artwork and original creative content appearing through Kelly Peters Art are protected by copyright and other applicable intellectual property laws.
Except where otherwise expressly stated or where rights belong to a third party, Kelly Peters retains rights in her original paintings, drawings, mixed-media works, murals, sketches, studies, designs, compositions, artwork imagery, photographs created by Kelly Peters, prints, illustrations, written creative material, graphics, logos, visual branding, videos, educational materials, and other original creative works.
Nothing on this Site should be interpreted as transferring intellectual property rights unless expressly stated in a written agreement.
10. PROHIBITED REPRODUCTION AND COMMERCIAL USE
Except with prior written permission from Kelly Peters or as otherwise permitted by applicable law, you may not reproduce or commercially exploit Kelly Peters artwork or other protected creative material.
Prohibited uses may include copying or reproducing artwork for sale; creating unauthorized prints or reproductions; manufacturing products containing the artwork; selling merchandise using the artwork; licensing the artwork to others; using artwork in advertising or commercial branding; substantially copying artwork to create commercial derivative products; distributing unauthorized digital reproductions; or otherwise exploiting protected artwork commercially.
Purchase or possession of artwork does not constitute permission for these uses.
No purchase from Kelly Peters Art constitutes a copyright assignment or commercial reproduction license unless expressly stated in a separate written agreement signed by Kelly Peters.
11. DIGITAL IMAGES
Images appearing on the Site are provided primarily for viewing, shopping, editorial, portfolio, and promotional purposes.
The availability of an image online does not place that image or the underlying artwork in the public domain.
Downloading, screenshotting, saving, reposting, or otherwise obtaining access to an image does not transfer copyright ownership or grant a commercial license.
12. SOCIAL MEDIA AND PERSONAL SHARING
Collectors and customers may photograph artwork they own and share those photographs for ordinary personal, noncommercial purposes, including on personal social-media accounts, subject to applicable law.
Such sharing does not grant any reproduction, merchandising, licensing, or other commercial rights.
Attribution to Kelly Peters / Kelly Peters Art is appreciated whenever reasonably practicable.
Artwork may not be presented in a manner that falsely suggests sponsorship, partnership, endorsement, collaboration, or affiliation with Kelly Peters Art.
13. ARTWORK IMAGES AND AI SYSTEMS
To the extent enforceable under applicable law, Kelly Peters Art does not authorize its copyrighted artwork, imagery, photographs, written content, or other proprietary creative material to be scraped, systematically collected, copied, or downloaded for the purpose of creating unauthorized datasets or training, fine-tuning, developing, or supplying generative artificial intelligence or machine-learning systems.
Nothing in this provision is intended to prohibit activity that cannot lawfully be restricted.
No license for such use is granted merely because content is publicly accessible through the Site.
14. COMMISSIONS
Commissioned artwork may be governed by a separate proposal, invoice, commission agreement, email agreement, or contract.
Where a separate written agreement exists, that agreement will control if it conflicts with these Terms regarding the particular commission.
Unless otherwise agreed in writing, Kelly Peters retains copyright and reproduction rights in commissioned artwork.
Commissioning an artwork does not make the artwork a "work made for hire" merely because a client paid for its creation.
Ownership of the physical commissioned artwork transfers according to the applicable commission agreement and payment terms, but copyright remains with Kelly Peters unless expressly transferred in a signed writing.
Kelly Peters may photograph and document commissioned work and use images of the completed artwork for her portfolio, website, social media, exhibitions, press, publications, archival purposes, and marketing unless otherwise agreed in writing.
Deposits, revision limits, timelines, shipping, installation, cancellation terms, and other commission-specific conditions may be established separately.
15. MURALS AND SITE-SPECIFIC ARTWORK
Murals and site-specific projects will generally be governed by separate proposals or contracts.
Unless a separate signed agreement expressly states otherwise, commissioning or paying for a mural does not automatically transfer copyright in the mural design or underlying artwork to the client.
Any rights relating to reproduction, merchandise, advertising campaigns, licensing, derivative commercial use, or reuse of a mural design should be addressed in a separate written license or agreement.
Rights concerning physical alteration, removal, destruction, conservation, or treatment of certain qualifying visual artworks may also be governed by applicable law.
16. LICENSING
Commercial licensing of Kelly Peters artwork requires separate authorization.
If you wish to use artwork for products, publications, hospitality, commercial interiors, advertising, packaging, apparel, merchandise, branding, collaborations, campaigns, or other commercial applications, contact Kelly Peters Art at kellypetersart@gmail.com regarding licensing.
A license exists only to the extent expressly granted.
No commercial license arises merely through purchasing artwork, contacting Kelly Peters Art, downloading an image, linking to the Site, or possessing an original or reproduction.
17. ARTWORK AUTHENTICITY AND RESALE
Where applicable, original artwork or limited-edition artwork may be accompanied by a signature, edition number, certificate of authenticity, or other identifying information.
Such documentation should be retained with the artwork.
Kelly Peters Art does not guarantee the future resale value, investment performance, appreciation, collectability, or secondary-market price of any artwork.
Artwork should be purchased because the purchaser wishes to own it, not based upon any guarantee of financial return.
18. SHIPPING AND DELIVERY
Shipping availability, cost, carrier, delivery method, insurance, and estimated delivery times may vary depending on the artwork, product, destination, and order.
Any delivery dates provided are estimates unless expressly guaranteed in writing.
Kelly Peters Art is not responsible for delays caused by carriers, weather, natural disasters, customs, incorrect addresses supplied by the purchaser, or circumstances outside our reasonable control.
Customers are responsible for providing an accurate and deliverable shipping address.
Additional shipping, storage, redelivery, rerouting, customs, duties, taxes, or related expenses caused by incorrect customer information or failure to receive a shipment may be the customer's responsibility where permitted by law.
19. SHIPPING DAMAGE
Artwork and products should be inspected promptly upon delivery.
If an item arrives visibly damaged, photograph the exterior packaging, shipping label, interior packaging, damage to the artwork or product, and overall condition of the shipment.
Contact Kelly Peters Art at kellypetersart@gmail.com within 3 days of delivery.
Keep all packaging until the claim has been resolved because the shipping carrier or insurer may require it.
Do not discard damaged packaging before contacting us.
We will evaluate damaged-shipment claims individually and may require additional documentation.
Nothing in this section limits rights or remedies that cannot legally be waived.
20. RETURNS AND EXCHANGES
Return eligibility depends upon the product purchased and any return conditions disclosed in the applicable product listing.
Unless otherwise stated in the applicable product listing or required by law:
Commissioned and custom artwork is final sale.
Personalized products are final sale.
Made-to-order products may be final sale.
Original artwork and limited-edition works may be subject to the return policy disclosed at the time of purchase.
Shipping costs and return shipping may be nonrefundable except where required by law or where the return results from our error or a qualifying damaged shipment.
Returned items must be returned in the condition required by the applicable return policy.
All sales of original artwork are final unless otherwise agreed to in writing or as otherwise required by applicable law. Print editions may be subject to product-specific return terms disclosed in the applicable product listing. Nothing in this section limits any rights or remedies that cannot legally be waived.
21. ORDER CANCELLATIONS
Requests to cancel an order should be submitted as soon as possible to kellypetersart@gmail.com.
Orders that have entered production, been customized, shipped, or otherwise become noncancelable may not be eligible for cancellation.
Commission cancellations are governed by the applicable commission agreement.
We reserve the right to cancel orders as described elsewhere in these Terms.
22. CLASSES, WORKSHOPS AND EVENTS
Kelly Peters Art may offer public and private classes, workshops, corporate events, children's programs, and other creative experiences.
Registration policies, cancellation deadlines, rescheduling policies, minimum attendance requirements, age requirements, pricing, materials, venue requirements, and other conditions may vary by event and may be stated in the applicable listing, proposal, invoice, or agreement.
Participants are expected to follow reasonable safety instructions and venue rules.
Art materials may stain or damage clothing and personal property. Participants are responsible for dressing appropriately and taking reasonable precautions.
Children must be supervised as required by the particular program or venue.
Kelly Peters Art may cancel or reschedule an event because of weather, illness, venue issues, insufficient enrollment, unsafe conditions, emergencies, or circumstances beyond reasonable control. Where Kelly Peters Art cancels an event, available remedies will be communicated to affected participants.
23. PHOTOGRAPHY AT EVENTS
Kelly Peters Art may photograph or record certain public classes, workshops, exhibitions, or events for documentation and promotional purposes where permitted by law and subject to any applicable notice or consent requirements.
For private events, children's events, or situations where additional permission is appropriate, separate permission may be requested.
If you do not wish to appear in promotional photography at an event, please notify Kelly Peters Art or event staff.
24. THIRD-PARTY SERVICES AND LINKS
The Site may contain links to or integrations with services operated by third parties, including payment processors, shipping providers, social-media platforms, scheduling systems, email providers, and other websites.
Kelly Peters Art does not control third-party websites or services and is not responsible for their content, availability, security, privacy practices, or independent actions.
Your use of third-party services may be governed by separate terms and policies provided by those third parties.
25. PROMOTIONS AND DISCOUNTS
Sales, discount codes, promotions, giveaways, or special offers may be subject to additional conditions.
Unless otherwise stated, promotions cannot be combined, have no cash value, and may be changed or discontinued as permitted by law.
Promotional pricing does not create an entitlement to a retroactive price adjustment on previous purchases unless expressly stated.
26. GIFT CARDS
If gift cards are offered, their use will be subject to the terms disclosed with the gift card and applicable law.
Gift cards may not be redeemed for cash except where required by law.
27. ACCURACY OF INFORMATION
We try to ensure that information on the Site is accurate, but errors may occasionally occur.
We do not warrant that every description, image, price, availability status, dimension, or other piece of information will always be completely error-free.
We reserve the right to correct errors and update information as appropriate, subject to applicable consumer-protection laws and contractual obligations.
28. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
KELLY PETERS ART MAKES NO WARRANTIES, EXPRESS OR IMPLIED, EXCEPT THOSE THAT CANNOT LEGALLY BE DISCLAIMED.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SITE WILL ALWAYS BE UNINTERRUPTED, COMPLETELY SECURE, ERROR-FREE, OR AVAILABLE AT ALL TIMES.
NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR CONSUMER RIGHTS THAT CANNOT LEGALLY BE EXCLUDED.
29. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KELLY PETERS ART AND KELLY PETERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO USE OF THE SITE, PRODUCTS, OR SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM A PARTICULAR PURCHASE, PRODUCT, OR SERVICE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO KELLY PETERS ART FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
These limitations do not apply where prohibited by applicable law.
30. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Kelly Peters Art and Kelly Peters from third-party claims, liabilities, damages, losses, and reasonable costs arising from your unlawful misuse of the Site or Services, your infringement of another person's rights, or your violation of these Terms.
This provision does not require you to indemnify Kelly Peters Art for conduct for which indemnification cannot lawfully be required.

Nothing in these Terms waives any copyright or other intellectual property rights belonging to Kelly Peters.
33. PRIVACY
Use of personal information collected through the Site is governed by our Privacy Policy.
Third-party service providers may separately process information according to their own privacy policies.
34. TERMINATION OR RESTRICTION OF ACCESS
We may suspend or terminate access to the Site or Services where reasonably necessary because of unlawful activity, fraud, abuse, security concerns, infringement, violation of these Terms, or other legitimate reasons, subject to applicable law.
Provisions that by their nature should survive termination, including intellectual-property provisions, limitations of liability, payment obligations, dispute provisions, and other accrued rights, will survive as applicable.

These Terms and disputes arising from them will be governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Nothing in this provision deprives a consumer of protections that cannot legally be waived.
36. INFORMAL DISPUTE RESOLUTION
Before initiating formal legal proceedings, you and Kelly Peters Art agree to make a reasonable good-faith effort to resolve the dispute informally where appropriate.

Nothing in this section prevents either party from seeking emergency or injunctive relief where appropriate or exercising rights that cannot legally be restricted.
37. VENUE
To the extent legally permitted and unless otherwise required by applicable law, legal proceedings arising from these Terms will be brought in an appropriate state or federal court located in Colorado.
38. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted or severed as appropriate, and the remaining provisions will remain in effect.
39. WAIVER
Failure by Kelly Peters Art to enforce a provision of these Terms does not constitute a permanent waiver of that provision or any other right.
A waiver will be effective only to the extent expressly provided.
40. CHANGES TO THESE TERMS
We may update these Terms from time to time.
The "Last Updated" date at the top of this page will reflect the most recent revision.
Material changes will apply prospectively as required by applicable law and will not retroactively alter completed transactions or existing contractual rights where doing so would be prohibited.
Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
41. ENTIRE AGREEMENT
These Terms, together with applicable policies, product descriptions, proposals, invoices, commission agreements, licensing agreements, workshop terms, or other agreements incorporated into a transaction, constitute the agreement between you and Kelly Peters Art regarding the applicable Site use, product, or Service.
If a separately signed written agreement conflicts with these general Terms regarding a specific project, the separately signed agreement will control for that project.
